Terms & Conditions
1. Introduction
These Terms and Conditions, together with our Privacy Policy, Code of Conduct, Enrolment Form and any other written information we brought to your attention before we confirmed your enrolment form the basis of your contract with us. Please read them carefully as they set out our respective rights and obligations. In these Terms and Conditions references to “you” and “your” include the first named person on the Enrolment Form and all persons on whose behalf a Program enrolment.
Please note that depending on what program, you enroll in, we will determine who your contract is with.
All UWC Summer Experiences (the Program) enrolments are made with Patagonia Education Partners LLC (PEP), a Florida Limited Liability Company with a registered address at 3390 Mary Street Suite 116 Miami, Florida 33133, United States.
By enrolling into our Program, the Participant and his or her parent/legal guardian, if Participant is under the age of 18, agrees on or on behalf of that participant that;
• he/she has read these Terms and Conditions and has the authority to and does agree to be bound by them;
• he/she consents to our use of personal data in accordance with our Privacy Policy and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
• he/she accepts financial responsibility for payment of the Program on behalf of the person detailed on the Enrolment Form.
2. Participation / Enrolment confirmation
2.1 After enrolling and paying the booking fee listed in clause 3 below, you will be sent a confirmation of enrolment (referred to below as “enrolment confirmation”) by PEP. A binding contract between you and PEP comes into existence when PEP dispatch the enrolment confirmation to the participant.
2.2 An invoice will follow after PEP receives the fee payment.
3. Program Fee
3.1 The Program fee and the Application fee required as published on PEP’s website are non-refundable.
3.2 The Program fee in effect at the time of enrolment is an integral part of the contract. Please refer to www.patagoniaeducation.com for the Program fee.
3.3 The Program fee is due and payable in full at the moment of acceptance into the Program. Only received payment by PEP, secures participation in the Program. Delay or lack of payment of the Program fee may result in loss of slot in the Program. The payment date is defined as the date at which the payment is credited to PEP account. Wire transfer payments should add Participant’s name.
3.4 All bank charges or credit card chages related to the payment of the Program’s fee shall be borne by you.
3.5 Delay or lack of payment of the Program fee may result in the participant no longer being entitled to the participate in the Program.
3.6 In case of non-attendance of the Program, delayed arrival, early departure or withdrawal from the Program, or any other absences (e.g. due to illness), there is no claim to reimbursement of the Program’s fees. Please refer to clause 10 with regards to Insurance requirements.
3.7 We reserve the right to amend our Program’s fees at any time. We also reserve the right to correct errors in both advertised and confirmed prices. We will try to provide reasonable notice of any such changes but you must check the price of your enrolment.
3.8 It is not possible to combine discount codes toward the Application fee.
3.9 At our discretion, we may offer a full or partial scholarship upon proof of need. Please contact us for further details.
3.10 If special airport transfers are arranged, their payments are final and non- refundable.
4. Accuracy
We endeavor to ensure that all the information we publish regarding the Program content, general information and prices, both on our website and in any advertising material we publish are accurate, however, occasionally, changes and errors do occur and we reserve the right to correct those details in such circumstances. You must check the Course price and all other details relating to the Program before you pay the Program fee.
5. Program Postponement / Deferral
5.1 In exceptional cases, approved by PEP, you may postpone your participation in the Program to the following year. This is subject to you obtaining our written consent to do so and subject to the payment of a postponement fee of $500.
5.2 If postponement is granted, PEP reserves the right to assign you to a different Program location.
6. Cancellation by You
6.1 You can cancel your participation in the Program but the Program fee is not refundable.
6.2 If the participant is unable to complete the Program for any reason whatsoever then no refunds of any nature will be applicable.
7. Cancellation and Changes by Us
7.1 We retain the right to cancel and/or amend the Program at any time for any reason whatsoever. In the event that we modify any session dates or destinations with twenty (20) days’ notification before the scheduled start date of the applicable session, no refunds will be granted. If for any reason you cannot attend the newly communicated session, we will issue a credit equal to the amount paid to us for the affected session, which may be applied toward any of our Program sessions offered during the following calendar year.
In the event the Program is cancelled, a refund of all monies paid to us by you will be made. We regret that we cannot meet any expenses or losses that you may incur as a result of a change or cancellation. Please keep this in mind when making additional commitments related to the Program, such as flights, hotel, and car reservations. In the event of cancellation, we will use our best efforts to give prompt notice.
7.2 Very rarely, we may be forced by Events Beyond Our Control (see clause 11) to change or cancel your Program, in which case we will offer you alternatives, a postponement of your booking or a full refund of all monies paid to us. If this situation does occur, we regret we will be unable to pay you compensation or meet any costs or expenses you incur as a result.
8. Course Rules
8.1 All students must show respect at all times to fellow students and members of our staff. The Program’s rules are outlined in our Enrolment Form. No refunds shall be issued due to a breach of the Program’s rules.
9. Responsibilities / Liabilities
9.1 We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:
a. the act(s) and/or omission(s) of the person(s) affected; or
b. the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
c. unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or
d. an event which either ourselves or suppliers could not, even with all due care, have foreseen or forestalled.
10. Insurance
10.1 All participants are encouraged to seek for their own travel/medical insurance.
10.2 Please note that Participants may be charged for damages to property belonging to us, the host venue, or that of another participant orstaff member.
10.3 All EU Nationals are required to bring valid documentation to avail of the medical benefits available to EU nationals.
10.4 If you choose to enroll in the Program without adequate insurance cover, we will not be liable for any losses howsoever arising.
11. Events Beyond Our Control
We will not be liable or pay you compensation if our contractual obligations to you are affected by Events Beyond Our Control. For the purpose of these Terms and Conditions, this means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination, epidemics or pandemics (including, but not limited to the ongoing effects of Covid-19 or any new strain of the coronavirus), or natural disasters such as floods, earthquakes or weather conditions, the act of any government or other national or local authority including any port or river authorities, industrial dispute, labor strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport, traffic congestion/restrictions and all similar events out of our or the supplier(s) concerned’s control.
12. Further Information
12.1 We make no guarantee of any specific results from the Program.
12.2 No part of the Program is intended to constitute advice and the content of the Program should not be relied upon when making any decisions or taking any action of any kind.
12.3 Any information that forms part of the Program is not designed with commercial purposes in mind. We make no representation or warranty that the Program or any content therein is suitable for use in commercial situations or that it constitutes accurate data and/or advice.
13. Applicable Law
These Terms and Conditions and all legal relations between us are governed by the laws of State of Florida. Only the Courts of Miami-Dade have exclusive jurisdiction over any dispute, claim or other matter which may arise between us (independently of where you live).
14. Display of the Agreement
A copy of these Terms and Conditions shall be available on our website at all times.
15. Promotional Materials
Participants may be asked to take part in promotional activities including but not limited to videos, photos, brochures, newsletters, website pages and general promotional activities.
16. Press
Participants are not permitted under any circumstances during the Program or at any time thereafter to give any statements or interviews to the press or any third parties regarding the Program, the Host, PEP, or any employee, member or agent of PEP, without our express written authorization.
17. Host
21.1 The Program shall take place at the premises of the Host (any UWC) unless otherwise advised by us at any time before the commencement of the Program.
21.2 The Participant agrees to comply with any rules and regulations in place at the Host including the Code of Conduct Rules found in our Enrolment Form.
22. Rules
22.1 Participants are expected to attend all provided meals, classes and arranged activities and excursions.
22.2 All damage to property, equipment and rooms will be charged to the partcipant.
23.3 Gratuitous or willful damage to college property, public property or other participants’ property will result in dismissal from the Program.
22.4 Consumption or possession of alcohol by students of any age is not permitted and will result in dismissal from the Program.
22.5 Drug-taking or possession of drugs will result in instant dismissal from the Program.
22.6 Racist or intimidating behavior towards another student or member of staff will result in dismissal from the Program.
22.7 Personal mobile phones must be turned off during all sessions and scheduled activities.
22.8 Smoking is strictly prohibited.
23. Visas
Where applicable, it is the responsibility of the Participant to ensure that they have the appropriate visa documentation to attend the Program for its duration. No refund will be issued to the Participant if they fail to procure the necessary visa, residency or travel documentation or fail to comply with any other requirements in order to attend the Program. We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses, which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.
